Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you.
You agree to indemnify, defend, and hold harmless CannabiSage™, its authors, contributors, owners, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to (a) your use of the Site, (b) any decision you make in reliance on information from the Site, (c) your violation of these Terms, or (d) your violation of any law or the rights of a third party.
The content of the Site — including articles, assessment text, question library entries, design, layout, logos, and the CannabiSage™ name and trademark — is the property of CannabiSage™ or its licensors and is protected by U.S. and international copyright and trademark law.
You may share links to Site content freely. You may print or download Site content for personal, non-commercial use, provided you do not remove any copyright or trademark notices. You may not reproduce, redistribute, modify, or create derivative works of Site content for commercial purposes, or in any way that suggests endorsement by or affiliation with CannabiSage™, without prior written permission.
The CannabiSage book is sold through third-party retailers (including Amazon) under the terms set by those retailers; the references to “the book pages” in these Terms refer to the promotional and supporting pages on this Site, not to the book’s content as sold elsewhere.
If you submit a question, message, or other content through the Site (including via the contact form), you grant CannabiSage™ a non-exclusive, worldwide, royalty-free, sublicensable license to use, modify, reproduce, and publish that content in connection with the Site (for example, to address suggested topics in a future article). You represent that any content you submit is your own or that you have the right to grant this license. We will not publish identifying information about you without your consent.
CannabiSage™ respects intellectual property rights. If you believe content on the Site infringes your copyright, please send a written notice to our designated agent at the address below, including: (a) your contact information; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material on the Site that is claimed to be infringing and its location on the Site; (d) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; (e) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the owner; and (f) your physical or electronic signature.

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
Any dispute arising out of or relating to these Terms or your use of the Site that cannot be resolved through informal discussion will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Miami-Dade County, Florida, or by remote means at the arbitrator’s discretion. Judgment on the arbitration award may be entered in any court with jurisdiction.
You and CannabiSage™ agree that disputes will be resolved on an individual basis only. Class actions, class-wide arbitrations, and consolidated proceedings are not permitted. If a court determines that this class-action waiver is unenforceable as to a particular dispute, that dispute (and only that dispute) will proceed in court rather than in arbitration.
You may opt out of this arbitration provision by sending written notice through the contact page within 30 days of first using the Site. If you opt out, the governing law and venue provisions in Section 14 still apply.
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Subject to Section 13 (Dispute Resolution; Binding Arbitration), any dispute that proceeds in court must be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. The “last updated” date at the top of this page indicates when changes were made. Material changes will be flagged on the homepage when appropriate. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and CannabiSage™ regarding the Site, and supersede any prior agreements or understandings.
